Wills, Trusts, and Estates: What is a Living Will

A living will is a legal document that specifies your healthcare preferences in case you are unable to communicate them. Generally, a living won’t go into effect until you have become incapacitated.


It is an advance directive that can provide guidance for doctors and hospitals on whether a patient wants life sustaining treatment. In the absence of a living will decisions about medical care become the responsibility of your spouse, a family member or a third party.


A will, on the other hand, is a legal document that describes how you want your property and other assets distributed after you pass away.



It is a good idea to have both. Last wills and living wills are different but both are important because they help you plan for the future and ensure your wishes are followed, giving your loved ones peace of mind.
